Mr. Bari, learned Senior Counsel appearing for the petitioners submit that the petitioner no.1 namely Suman Gurung filed an earlier writ petition which was dismissed as not pressed.

The learned Advocate appearing for the GTA and the State also submits that the writ petition filed by Suman Gurung was dismissed as not pressed without any liberty to sue afresh.

It appears that by an order 18th of January, 2024 in WPA 691 of 2022 that the said writ petition filed by Suman Gurung was dismissed as not pressed. In view thereof, the writ petition being WPA 681 of 2025 in so far as the writ petitioner no.1 namely Suman Gurung is concerned stands dismissed as not pressed.

The petitioner no. 2 is permitted to proceed with this writ petition.
