Mr. Sandip Mondal Mr. Amit Saha Ms. Poonam Kaur ...for the Opposite Party no.2 Learned advocate appearing for the petitioner and defacto complainant have approached this Court after an amicable settlement was arrived at between them in connection with Cyber Crime PS, Siliguri Police Commissionerate case no. 32/25 dated 10.03.2025. The investigation of the said case is pending. The Case Diary has been produced and a joint compromise application has been filed by the petitioner as well as the de-facto complainant. Both the parties have prayed for quashing of the proceedings.
I have taken into account the nature of the allegations and the mutual/amicable settlement arrived at by and between the parties, the petitioner and the opposite party no.2 are husband and wife and the genesis of the dispute arose out of matrimonial discord. Having considered the nature of the allegations and the fact that the investigation although it has commenced but has not been taken to its logical conclusion because of the process of expert opinion yet to be collected, I am of the view that in the changed circumstances further continuation of the proceedings would be not furthering the cause of justice.
Accordingly, all further proceedings of Cyber Crime PS, Siliguri Police Commissionerate case no.
32/25 dated 10.03.2025 under the Section 66/66B/66C of the Information Technology Act, 2000 is hereby quashed.
Consequently, CRR 147 of 2025 along with CRAN 2 of 2025 be hereby allowed.
Pending application, if any, is consequently disposed of. Memo of evidence submitted by the State be kept with the record.
Case Diary be returned to the learned advocate for the State.
