Imrohi ...For the Petitioner Mr. Supriya Singh Mr. Vikash Agarwal ...For the Respondent Nos. 2 & 3 Mr. Rajdeep Biswas ...For Union of India This is an application under Article 226 of the akb Constitution of India wherein the writ petitioner is aggrieved by the inaction on the part of the respondent authorities in not passing order with regard to the compensation that is payable to the writ petitioner. Learned Counsel appearing on behalf of the petitioner submits that a hearing has been given on February 22, 2019 on the representation dated December 03, 2018 made by the petitioner but no order has yet been passed.

I have heard the learned Counsel appearing on behalf of the parties and perused the materials placed on record.

In the light of the above submission, I direct the Special Land Acquisition Officer and Competent Authority for Land Acquisition, Jalpaiguri, being the respondent No. 7 to consider the representation of the petitioner after granting an opportunity of hearing to the petitioner, thereafter, to pass a reasoned order within a period of four weeks from the date of communication of this order.

Respondent No. 7 is also directed to communicate the reasoned order to the petitioner within a week from the

date of passing the reasoned order.

With the aforesaid observation, the writ petition is disposed of.

Since, no affidavit-in-opposition has been called for, the allegations made in the writ petition are deemed to have not been admitted by the respondents. There will be no order as to costs.
