Mr. Kunaljit Bhattacharya Mr. Haider Ali Mr. Alok Sah Mr. Satyam Sarkar ...for the Petitioner Mr. Momenur Rahman Mr. Sumit Kumar ...for the State The petitioner who is engaged in the business of providing manpower services to various Government department and Institutions claims to have provided security guards and housekeeping services to various Covid-19 hospitals and safe-houses during the Covid19 Pandemic. The petitioner states that the bills were raised by the petitioner in that regard. However, a portion of the same has only been cleared by the concerned authority and a substantial amount is still lying outstanding.

The petitioner submitted a representation dated December 27, 2024 to the Chief Medical Officer of Health, Darjeeling District at Siliguri.

The learned Advocate appearing for the petitioner submits that no decision on such representation has been communicated to the

petitioner till date. The learned Advocate appearing for the State submits that the claim made by the petitioner is not an admitted claim.

The learned Advocate for the State, however, could not produce any decision of the authority in support of such submission that the petitioner has made any claim without rendering any service there for.

Without entering into the veracity and legality of the claim made by the petitioner in the said representation as well as in the writ petition, WPA 686 of 2025 is disposed of by directing the Chief Medical Officer of Health, Darjeeling District at Siliguri being the 3rd respondent herein to consider the representation of the petitioner dated 27th December, 2024 and to dispose of the same by passing a reasoned order after giving an opportunity of hearing to the petitioner or his authorized representative and communicate such reasoned order to the petitioner immediately thereafter. The entire exercise shall be completed as expeditiously as possible but positively within a period of six weeks from the date of receipt of a server copy of this order. It is however made clear it will be open to the petitioner to produce materials in support his claim that the petitioner rendered service of providing security guards and housekeeping service

to various Covid-19 hospitals and safe-houses for the relevant period.
