The petitioner retired as an Assistant Teacher from the Patlakhaur High School, Cooch Behar after thirty three years of service on 31st March, 2000. The case made out is that the pay scale of the petitioner was revised from time to time under relevant Government orders but after the pension payment order was issued on 7th February, 2007, the petitioner found that the concerned authorities have deducted an amount of Rs. 29,342/- from the gratuity of the petitioner.

Learned counsel appearing for the petitioner submits that no reasons have been given by the concerned authorities for such deduction in the basic pay drawn.

Learned Government Pleader submits that the case of the petitioner can be considered by the appropriate authorities in this case the Director of Pension, Provident Fund and Group Insurance being the respondent no.2.

Having regard to the submissions made by learned counsel, this court deems it fit to give the liberty to the petitioner to treat the writ petition as a representation to be considered by the respondent no.2 and for the respondent no.2 to pass a reasoned order on such representation after hearing all the concerned parties within a period of four weeks from date. A copy of the reasoned order will be made available to the petitioner within a week from the date on which such order is passed.

W.P.A. 480 of 2019 is disposed of in terms of the above.
