IN THE HIGH COURT AT CALCUTTA

CIRCUIT BENCH AT JALPAIGURI WPA 645 of 2024 Uttam Barman -Versus- The State of West Bengal and Ors.

Mr. Subhasish Misra Mr. Satyajit Paul .....For the Petitioner Mr. Subir Kumar Saha Mr. Nabankur Paul ..for the State It is the grievance of the petitioner that he joined as a Headmaster at Sagar Roy Rajbangshi Vasa Prathamik Vidyalaya on December 23, 2014. After serving for about nine years, his service has been discontinued by the school authority.

The petitioner submits that the school authority, in an arbitrary manner, is not allowing the petitioner to attend his duties. He prays for consideration of his representation at page 18 of the writ petition. I am of the view that this writ petition is not maintainable. Nothing has been pleaded in this writ petition to show that the respondents are authorities under Article 12 of the Constitution of India. I am of the opinion that the termination of service of the petitioner is not amenable to writ jurisdiction in view of the judgment of the Supreme Court reported at

(2023) 4 SCC 498 (St. Mary's Education Society v. Rajendra Prasad Bhargava).

Accordingly, WPA 645 2024 is dismissed.

Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
