1. In support of the application for bail learned counsel for the petitioner submits before this Court that the present accused petitioner is similary circumstanced with another co-accused Amar Basfore, who has been enlarged on bail on 07.03.2024 in CRM (NDPS) 55 of 2024.

2. Learned counsel for the State opposes the prayer for bail though he candidly submits that the footing of the present accused petitioner is similar to the said co-accused, who has been enlarged on bail.

3. On the ground of parity, we are inclined to grant bail to the present accused petitioner.

4. Accordingly, we direct that the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/-, with two registered sureties of like amount each, one of whom must be local and subject to the satisfaction

of the Learned Judge, Special Court (under NDPS Act), Siliguri. The petitioner shall not induce witnesses or influence them or tamper with the evidence. The petitioner shall also make himself available for the trial as and when the petitioner is required and shall also not leave the jurisdiction of the concerned police station without the leave of the concerned authorities.

5. CRM (NDPS) 176 of 2024 is accordingly allowed and disposed of in terms of the above.

6. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
