Bijolika Dey @ Saha Mr. Gopal Sah .....For the Petitioner Mr. Milindo Paul Mr. Nabankur Paul Ms. Sutapa Sen Paul Ms. Bedasruti Bose Mr. Subham Das .....For the Opposite Party Learned counsel appearing on behalf of the petitioner submitted that original application under Guardians and Wards Act (VIII of 1890) was somehow filed within the jurisdiction of Jalpaiguri whereas minor child is a resident of District - Darjeeling and, therefore, the application under the Guardians and Wards Act ought to have been filed before the Court having jurisdiction within the District - Darjeeling. Learned counsel appearing on behalf of the petitioner is also inclined to not press this application.
With this above observation, the instant revisional application, which was filed for transferring the case from the Court of the learned District Judge, Jalpaiguri to the Court of learned District Judge, Darjeeling stands dismissed as not pressed.
Petitioner is at liberty to make necessary application before the learned Trial Court.
