The petitioner is a contractor who was engaged by the Haldibari Municipality and in whose favour a work order dated 15th March, 2017 was issued. The petitioner complains of not being paid any amount for the work done by the petitioner despite a completion certificate being issued by the Haldibari Municipality to the petitioner on 7th August, 2019. Learned counsel for the petitioner submits that the Municipality informed the petitioner that no payment would be made because of lack of funds.

Learned Government Pleader appearing for the State proposes that the respondent no.4 being the Executive Officer, Haldibari Muicipality will consider the case of the petitioner and address the dispute raised in the present writ petition.

Having heard learned counsel for the parties, this court deems it fit to direct the respondent no.4 to consider the case of the petitioner upon all available

materials and after giving the petitioner a proper hearing. The respondent no.4 is directed to pass a reasoned order upon considering the case of the petitioner within a period of four weeks from date. A copy of the reasoned order should be made available to the petitioner five days from the date on which such order is passed.

W.P.A. 498 of 2019 is disposed of in terms of the above.
