1. The de facto complainant has submitted that she has no objection to her mother-in-law being enlarged on bail since all the accused are on bail. The de facto complainant is residing with her in-laws and her husband.

2. Although charge sheet has been filed, this Court is of the view that since the de facto complainant has no objection or fear of any further torture from her mother-in-law and other in-laws, the application for bail of the petitioner may be allowed.

3. The petitioner shall be enlarged on bail on the undertaking that she shall not harass the de facto complainant and she also protects her in the event of any harassment of the de facto complainant by other in-laws.

4. Let the petitioner be released on bail upon furnishing a bond of Rs. 5,000/- with two sureties of like amount each, to the satisfaction of the Learned Chief Judicial Magistrate, Alipurduar, subject to the condition that after release, the petitioner shall not leave the jurisdiction of the Alipurduar Police Station without the leave of the Inspector-in-Charge, Alipurduar Police Station and also on the condition that the petitioner shall attend the Court below on all the dates, as specified for hearing.

5. It is made clear that in the event the petitioner fails to comply with the aforesaid directions, the Learned Trial Court would be at liberty to cancel her bail bonds in accordance with law without any further reference to this Court.

6. Hence, CRM (M) 108 of 2026 shall stand disposed of.

7. Case diary be returned.

8. All the parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Rajasekhar Mantha, J.)
