This is an application under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by the inaction on the part of the respondent authorities.
Learned Counsel appearing on behalf of the respondent No. 7 files a report as has been directed by this court dated September 09, 2019. The said report is self-explanatory and indicates that all the records of the petitioner has been sent to the respondent No. 4, being the District inspector of Schools (S.E.), Cooch Behar. In the light of the above, the respondent No. 4 is directed to immediately take action upon the papers/records received and process the same to issue 'pension payment order' and send it to the Director of Pension, Provident fund and Group insurance (DPPG) within a period of four weeks from date.
The Director of Pension, Provident Fund and Group Insurance (DPPG) is also further directed to release the pension in favour of the petitioner within a period of two weeks from the receipt of the papers from the District Inspector of School (S.E.), Cooch Behar. With the aforesaid observation, the writ petition is disposed of.
Since, no affidavit-in-opposition has been called for, the allegations made in the writ petition are deemed to have not been admitted by the respondents. There will be no order as to costs.
Urgent photostat certified copy of this order, if applied for, be given to the parties, on priority basis. ( Shekhar B. Saraf, J.)
