Petitioner having the qualification of Bio Science (Pass) is presently serving as an Assistant Teacher at Bara Madhusudan Rupeswar Ray High School in the District of Coochbehar in the normal section. The petitioner claims that his wife is suffering from some ailments and the petitioner is also facing difficulty to attend the school from his residence by travelling a distance of about 650km. For such reason the petitioner prayed for transfer to a school which is near to his residence.

The State and the School Service Commission are represented by their respective learned Advocates. Record reveals that the prayer for transfer which was made through UTSHASHREE portal has

been forwarded to the School Service Commission on October 14, 2022. The learned Advocate appearing for the School Service Commission, in his usual fairness, submits that no decision with regard to the prayer for transfer of the petitioner has yet been taken. In the light of the submissions made by the learned Advocates for the parties, WPA 701 of 2025 is disposed of by directing the Chairman, West Bengal Central School Service Commission being the 4th respondent to consider the prayer for transfer of the petitioner in accordance with law and to take a decision in that regard as expeditiously as possible but positively within a period of six weeks from the date of receipt of a server copy of this order.
