1. In view of the fact that the co-accused persons similarly placed as that of the petitioner have been granted anticipatory bail by Coordinate Benches at different point of time, we are inclined to allow the prayer for anticipatory bail to the petitioner.

2. Accordingly, we direct that in the event of arrest, the petitioner, namely, Biren Barman, be released on bail upon furnishing a bond of Rs.10,000/-, with two registered sureties of like amount each, to the satisfaction

of the learned Additional Chief Judicial Magistrate, Dinhata in connection with G.R. Case No.378 of 2023 and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973. It is further directed that the petitioner shall appear before the learned trial Court within a fortnight from today.

3. The application for anticipatory bail is, thus, disposed of.
