The petitioners state that the son of the petitioner no. 1 namely, Tarapada Sarkar, while working as a Laboratory Assistant in Gosanimari High School, died in harness on May 22, 2023 leaving behind him surviving his two minor children, i.e., the petitioner nos. 2 and 3, who are being represented by the petitioner no. 1. The petitioners state that the family pension on account of the service of the deceased son of the petitioner no. 1, has not yet been released in favour of the
petitioners in spite of several representations being made in that regard.
The learned advocate appearing for the petitioners submits that the petitioner no. 1 has submitted a representation dated March 4, 2025 before the District Inspector of Schools (Secondary Education), Coochbehar praying for releasing the family pension and gratuity in favour of the petitioners. But till date, no decision on such representation has been communicated to the petitioners.
Learned advocate appearing for the State submits that the decision on the representation shall be taken and communicated to the petitioners within the time limit as may be fixed by this Court. Without entering into the merits of the claim made by the petitioners in this writ petition, WPA 706 of 2025 is disposed of by directing the District Inspector of Schools (Secondary Education), Coochbehar, being the 3rd respondent herein, to consider the representation of the petitioner no. 1 dated March 4, 2025 and to dispose of the same by passing a reasoned order after giving an opportunity of hearing to the petitioners or any other interested
parties who may be affected by the said decision or their authorized representatives.
Needless to mention that the reasoned order shall be communicated to the respective parties immediately thereafter.
The entire exercise shall be completed as expeditiously as possible but, positively within a period of four weeks from the date of receipt of a server copy of this order along with the representation dated March 4, 2025.
