Mr. Sudip Guha, ..........For the petitioner Mr. Aditi Shankar Chakraborty, Mr. Sourav Ganguli, ......For the State This is an application under Section 439 of the Code of Criminal Procedure read with Section 483 of the BNSS filed by the petitioner who is in custody in connection with Birpara Police Station case No. 116 of 2023 dated 24/08/2023.

Heard Learned Advocate for the petitioner and Learned Advocate for the opposite party State of West Bengal. Perused the material in the case diary.

Upon perusing the materials in the case diary and upon considering the facts of the case this Court is of the view that although petitioner is in custody for 543 days but as there are statements against him showing involvement, it would not be proper to grant bail to the petitioner at this stage. The prayer for bail made by the petitioner thus stands rejected at this stage with the liberty to pray for bail before trial Court if the trial is not completed within 5 months.

This CRM (M) 13 of 2025 stands disposed.
