It is submitted on behalf of the State respondents that the entire case of the petitioner for recovery of an amount of Rs.7,08,213/- along with interest on account of refund of pensionary benefits is misconceived and erroneous. There has been gross suppression in this case. The petitioner had taken voluntary retirement from service on medical grounds before attaining the age of 58. The wife of the petitioner has also been given compassionate appointment.

In such circumstances, the writ petition is liable to be dismissed on the ground of suppression.

The matter has been repeatedly adjourned when the petitioner has remained unrepresented. In view of the repeated non-appearance of the petitioner, WPA/797/2023 stands dismissed for default.
