IN THE HIGH COURT AT CALCUTTA

Sl. No.90 Circuit Bench at Jalpaiguri akd [Rejected] C. R. M. (A) 318 of 2024 In Re: An application for anticipatory bail under Section 438 of the Code of Criminal Procedure filed on 01.04.2024 in connection with NCB Crime No. 25/NCB/KOL/2023 (NDPS Case No.45 of 2023) dated 21.08.2023 under Sections 8(c)/21(c)/22(c)/29 of the NDPS Act. And In Re: Ashraful Alam @ Alom ... ... Petitioner Mr. Kumar Shantanu ... ... for the petitioner Mr. Sudipto Kumar Mazumdar .. ld. Dy. Solicitor General of India Mr. Sudip Kumar Paul ... ... for the State

1. Heard the learned Advocates appearing for both the parties.

2. We have considered the materials on record. Prayer for anticipatory bail of the petitioner was turned down by a coordinate Bench of this court. Petitioner strenuously argues that he has renewed his prayer after filing of police report. Filing of police report is an aggravating and not an extenuating circumstance. Under these circumstances, we are of the opinion no case for revisiting the issue arises.

3. Hence, the prayer for anticipatory bail of the petitioner stands rejected.
