DSGI Mr. Sudip Kumar Paul ..for the State The petitioner is aggrieved by the fact that the petitioner has secured the normalize score of 42.750 but the petitioner was not appointed to the post of Constable/ Bugler whereas one Indrajit Roy who also scored the same normalize score of 42.750 was appointed.

The petitioner submitted a representation before the concerned authority ventilating his grievances. The DIG (Recruitment Directorate) by an order dated February 28, 2025 has held that due to the petitioner securing less marks in Part-A of CBT than the last selected candidates the petitioner's name could not find place in the merit list. The said authority noted that as per the advertisement notice dated March 15, 2023, in the event of tie in scores of candidates in CBT, such cases will be resolved by applying following criteria, one

after another in the given order, till the tie is resolved. The said criteria is set out hereunder:

"Para 15.1 : Marks in Part-"A"

Para 15.-2 : Marks in Part-"B"

Para 15.3 : Date of Birth, with older candidates placed higher.

Para 15.4 : Alphabetical order of names."

The said authority on facts found that the petitioner secured less marks in Part-A than the said Indrajit Roy. There is no infirmity in the decision of the DIG (Recruitment Directorate) dated February 28, 2025. For such reason, this Court is not inclined to grant any relief in favour of the petitioner. WPA 711 of 2025 stands disposed of.

No order as to costs.
