1. The petitioner has been arrested in connection with FIR No.175/2026 dated March 5, under Sections 126(2)/115(2)/118(2)/103/3(5) of the Bharatiya Nyaya Sanhita, 2023. He is in custody since March 5, 2026.
2. Learned advocate for the petitioner submits that the petitioner is not the primary accused. The investigation of the case is over and charge sheet has been submitted. At this stage there is no requirement of keeping the petitioner in custody.
3. Prayer has been made to grant bail to the petitioner.
4. The prayer for bail is opposed by the learned counsel for the State. The case diary has been produced. The same is perused.
5. Learned advocate representing the State submits that the petitioner is highly involved in the offence. He is the FIR
named accused and charge sheet has also been filed against him.
6. It appears from the case diary that the investigation is already over and charge sheet being No.344/2026 dated June 2, 2026 has already been filed. The trial of the case will take some time.
7. In view of the fact that charge sheet has already been filed in the instant case and further custodial interrogation of the petitioner may not be required, I am of the opinion that further detention of the petitioner is unwarranted.
8. As such, the prayer for grant of bail of the petitioner is allowed.
9. The petitioner, viz. Goutam Adhikary is released on bail of Rs.20,000/- (rupees twenty thousand only) with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Cooch Behar subject to the condition that the petitioner shall appear before the learned Trial Court on every date of hearing until further order. The petitioner shall not threaten, tamper or intimidate the complainant or members of the family in any manner whatsoever or commit similar offence in future. The petitioner shall meet the Inspector-in-Charge of the jurisdictional police station once in every week and shall not leave the jurisdiction of the learned Trial Court until further order.
10. In case the petitioner violates any such condition, the prosecution will be at liberty to move an application for cancellation of bail.
11. CRM (M) 116 of 2026 is allowed.
12. Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court.
13. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
