Learned counsel representing the petitioner submits that nothing has been recovered from this accused person though he has been named in the FIR and the charge-sheet. He further submits that the accused is in custody for about 70 days. Chargesheet has also been filed. Relying on this facts, learned counsel seeks bail.

Learned Additional Public Prosecutor has been candid enough to submit that eight co-accused persons are on bail. 3.

Considering the fact that charge-sheet has already been filed and eight other co-accused persons are already on bail, this Court is inclined to grant bail to the petitioner.

Accordingly, the petitioner shall be released on bail upon furnishing bond of Rs.20,000/- with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the NDPS Act, Jalpaiguri on conditions that the petitioner shall appear before the trial court on every date of hearing and shall not intimidate witnesses or tamper with evidence in any manner whatsoever and on further condition that the petitioner shall not leave the jurisdiction of the district of Jalpaiguri without prior permission of the Trial Court. 5.

In the event the petitioner fails to comply with the aforesaid conditions without any justifiable cause, the Trial Court shall be at liberty to cancel his bail without reference to this Court. 6.

The case diary is returned to the learned Additional Public Prosecutor in Court today.

The application for bail is thus disposed of. 8.
