Case No. 2072 of 2021 arising out of Kalchini Police Station Case No. 140 of 2021 dated 22.09.2021 under Sections 452/307/506/34 of the Indian Penal Code; read with 25(1)(a)/27 Arms Act.

APP Mr. Sourav Ganguly, Advocates ... ...For the State Considering the period of detention of the petitioner and considering the fact that police filed charge sheet, inter alia, under Sections 452/506/34 of the IPC after conducting investigations under Sections 452/307/506/34 of the IPC read with Sections 25(1)(a)/27 Arms Act, we are inclined to grant bail to the petitioner.

Accordingly, we direct that the petitioner shall be released on bail upon furnishing a bond of Rs. 10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the Learned Additional Chief Judicial Magistrate, Alipurduar subject to condition that the petitioner shall appear before the learned trial court on every date of hearing until further orders and shall not intimidate

witnesses and/or tamper with evidence in any manner whatsoever.

In the event, the petitioner fails to comply with the conditions as enshrined hereinbefore, it is open to the trial court to cancel the bail without further reference to this Court.

The prayer for bail of the petitioner is allowed. CRM (DB) 151 of 2022 is disposed of.
