Affidavit-in-opposition filed by the applicant to the affidavit of compliance filed by the alleged contemnors is taken on record.

Learned advocate representing the applicant draws attention of the Court to the communication made by the Assistant Engineer, Dhupguri Highway Sub Division on April 7, 2025 to the Officer-in-Charge, Dhupguri Police Station intimating the police that illegal construction and filling up of earth on the Government land in the left side after Daukimari market on Dhupguri-Nathua road was going on within the Right of Way of Dhupguri-Nathua road. The police was requested to take necessary action to stop encroachment on Government land immediately.

Affidavit of compliance filed by the Pradhan of the Gram Panchayat mentions that a spot inspection

was conducted and it was found that the land in question is not in possession of any private individual. 4.

The Assistant Engineer is directed to cause spot inspection to ascertain as to whether any Government land, be it PWD land or Panchayat land, has been encroached upon by any private individual or not. 5.

Prior notice of spot inspection shall be served upon the applicant, the Pradhan of the Gram Panchayat and all other necessary parties.

Report of the spot inspection shall be served upon the respective parties and be placed before this Court on the adjourned date.

It will be open for the Assistant Engineer to take assistance of the concerned Block Land and Land Reforms Officer for the purpose of proper identification of the subject land.

Let this order be communicated to the learned advocate representing the alleged contemnor no.2, i.e., the Pradhan of the Gram Panchayat.

Photocopy of the affidavit of compliance on behalf of the alleged contemnor no.2 handed over by the learned advocate representing the applicant in Court today be retained with the records.

Re-list the matter on April 23, 2026.
