For the WBSEDCL It is contended on behalf of the petitioner that the petitioner is an advocate and is carrying on her profession in a chamber at DIB Compound near the District Library, Kalimpong. The petitioner was granted electricity connection in the said chamber under 'domestic' category on 27th October, 2018 and has been enjoying electricity in the chamber since then. Subsequently, the said connection was converted into 'commercial' category connection without any notice being served on the petitioner and exorbitant electric charges were slapped upon the petitioner.

The petitioner submitted representation before the concerned Authority on

13th March, 2020 which is yet to be disposed of. The petitioner prays for a direction upon the Authority to consider the representation at the earliest as the petitioner is continuing her profession in the chamber without any electricity.

Having considered the submissions made on behalf of the parties and material on record the writ petition is disposed of directing the 4th respondent to consider and dispose of the representation submitted by the petitioner dated 13th March, 2020 within two weeks from the date of communication of this order after affording reasonable opportunity of hearing to the petitioner, in accordance with law. The decision taken by the Authority shall be communicated to the petitioner within a week thereof.

With the above observations and directions, W.P.A. 985 of 2022 is disposed of.

There shall be no order as to costs.

Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted.

Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
