By an order dated 14th May, 2025 this Court has directed the I.O. to be present before this Court in person along with victim and CD. The victim is present along with her child and I.O. is also present with the CD.

This Court has examined the victim and submits that she is residing in the house of accused and with her father in law as the and mother-in-law has passed away. She submits that the child is

about 6 months old and she is facing difficulty as there is nobody to look after the victim and minor child.

After hearing the victim, this Court finds that no purpose would be served if the petitioner is kept in correctional home. The petitioner may find bail of Rs. 5,000/- with one surety with the satisfaction of the Learned Special Court (POCSO), Siliguri, Darjeeling.

If on bail, the petitioner is directed to appear before the Trial Court on each and every date of hearing.

CRR (M) 33 of 2025 is disposed of.
