On the prayer of the learned Advocate for the petitioner, leave is granted to implead the District Inspector of Schools (SE), Alipurduar as added respondent no.8 in the cause-title of the writ petition.

By the present writ petition, the petitioner seeks direction upon the respondent authorities to consider his transfer application dated 5th January, 2026.

Mr. Shuvro Prokash Lahiri, learned Advocate appearing on behalf of the petitioner submits that pursuant to order passed in WPA 441 of 2025 the petitioner made a fresh application before the school authority which has been duly
forwarded to the District Inspector of Schools (S.E.), Alipurduar on 7th January, 2026.
However, the same is still pending at the end of the District Inspector of Schools (SE), Alipurduar. He seeks appropriate order directing the District Inspector of Schools (SE), Alipurduar, added respondent no.8 to consider the prayer of the petitioner seeking transfer expeditiously.

Mr.
Sunit Kumar Roy, learned Advocate appearing on behalf of the West Bengal Central School Service Commission concedes to such submission.

Ms.
Radhika Agarwal, learned Advocate appearing on behalf of the State submits that she has not received any instruction as yet.

On 8th June 2026 the State-respondents sought accommodation to take instruction.
Such instruction as submitted has not yet been received. Be that as it may, since the prayer of the petitioner for transfer is pending at the end of added respondent no.8, District Inspector of Schools (SE), Alipurduar, this Court deems it fit to direct the said authority to consider the application of the petitioner seeking transfer, which is pending at its end.

In light of the above, District Inspector of Schools (SE), Alipurduar, added respondent no.8 is
directed to consider the application of the petitioner seeking transfer dated 5th January, 2026 in accordance with notification of the School Education Department, Secondary Branch being No.09-SE/SE/B/IS-04/95(Pt III) dated 3rd January, 2022, within a period of four weeks from the date of communication of this order and shall take all consequential steps in the event the petitioner is found to be eligible and forward the same to the West Bengal Central School Service Commission which shall take appropriate steps within a period of four weeks from the date of receipt thereof.

With the above direction, the writ petition being WPA 684 of 2026 stands disposed of.

Petitioner is directed to communicate this order to the District Inspector Schools (SE), Alipurduar, added respondent no.8 for necessary compliance.
10. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted.
11. Interim order, if any, stands vacated.
12. All connected applications, if any, stand disposed of.
13. There shall be no order as to costs.
14. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.
15. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
