The Public Health Engineering Department had proposed a project and for this purpose, was in the process of utilizing a portion of land belonging to the petitioner. The petitioner accordingly made a prayer that his land may be acquired formally by the concerned authorities. However, in the meantime, the Public Health Engineering Department, Cooch Behar has decided to bring up the project at a different site and has accordingly, released the land where they had nevertheless done some digging. Therefore, the present writ petition has become infructuous.

Learned counsel appearing on behalf of the State submits that the Department has decided to do the project at a different site and has accordingly, released the land of the petitioner that was in the process of getting utilized.

In view of the above, the writ petition is disposed of without any further order, even as to costs.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
