Mr. Soumyajit Das Mahapatra, Mrs. Rima Das .... For the petitioner. Mr. Robiul Islam ... for the State. The writ petition is taken up for consideration subsequent to the order dated September 23, 2019. The respondent no.5 is present in Court.
The petitioner has two children. The petitioner has grievance against the respondent no.5 who is her son. According to the petitioner, since, the entire house is owned by the petitioner, the respondent no.5 should not reside thereat.
Learned Advocate appearing for the respondent no.5 submits that, he has no objection if the petitioner occupies two rooms out of the four rooms in the premises. According to him, the writ petition is at the behest of his sister who is trying to grab the property. In the facts of the present case, in my view, justice would be subserved by permitting the petitioner to occupy two rooms at the premises concerned. The
petitioner will report to the concerned Officer-in-Charge of the local police station who will ensure that, no breach of peace occurs at the locale when the petitioner returns to her residence.
The private parties are at liberty to have their disputes resolved with regard to the property before the appropriate forum, in accordance with law.
WP No.18221(W) of 2019 is disposed of.
No order as to costs.
