Mr. Victor Chatterjee, Mr. Soumya Majumder for the petitioner Mr. Susanta Pal, Ms. Ananya Neogi for the State The petitioner was engaged as a Civil Police Volunteer and attached with the Tufanganj Police Station, Coochbehar.

The petitioner alleges that his name was included as a co-accused in a complaint which was lodged by one of his distant relative. In response to the said complaint G.R. Case No. 497 of 2018 was initiated by the police station. On the basis of such complaint, the petitioner was verbally suspended from his duties on and from 22nd October 2018. The petitioner applied for anticipatory bail and the same was granted in his favour on 19th January, 2019. The petitioner made a representation on 5th April, 2019 before the Superintendent of Police, Coochbehar with a request to allow him to resume his duties.

The petitioner prays for a direction upon the said respondent for consideration of his representation.

The learned advocate appearing for the State respondent relies upon the guidelines for the eligibility, mode of induction, training, duties and termination of voluntary service for Civic Police Volunteer Force. According to the said guidelines, a volunteer becomes ineligible for continuing in the service in case of involvement in any criminal case.

Admittedly, in the instant case the petitioner has been involved in a criminal case. Until and unless the petitioner gets himself discharged from the said criminal case, no direction can be passed upon the respondents to allow the petitioner to resume his duties.

In view of the above, no relief can be granted to the petitioner in the instant case.

W.P. No. 18427 (W) of 2019 stands dismissed.
