Ashok Kumar Chowdhuri @ Ashok Kumar Choudhury v. State Of West Bengal And ANR.
30.10.19 Sl.no. 81 Ct. No. 33 P.M.
C. R. R. 2739 OF 2019 Ashok Kumar Chowdhuri @ Ashok Kumar Choudhury - vs - The State of West Bengal & Anr.
Mr. Sekhar Kumar Basu, Sr. Adv.
Mr. Arindam Dey.
... for the petitioner.
Mr. Swapan Banerjee, Mr. Suman De.
... for the State This revision is prayed for G.R. Case No. 1001 of 2018 in connection with Pradhan Nagar P.S. Case No. 193 of 2018. The revisionists had originally moved for an anticipatory bail which was rejected by a Division Bench of this Court in C.R.M. No. 10928 of 2018. However, subsequently an application for anticipatory bail filed by another accused, was allowed.
Since the reasons for grant of anticipatory bail to one accused may differ from reasons to decline for another accused and the factum of grant of anticipatory bail by itself would not render the proceeding nugatory, this court is not inclined to interfere with the investigation at this stage. The Investigating Officer of the Pradhan Nagar Police Station is directed to complete the investigation as expeditiously as possible and submit a final report before the
Magistrate concerned preferably within a period of four months from the date of communication of this order.
C.R.R. 2739 of 2019 shall stand disposed of.
Urgent photostat certified copy of this order, if applied for, be given to the applicant upon compliance of requisite formalities. (Rajasekhar Mantha, J.)
