Shib Sankar Das v. State Of West Bengal And ORS.
05.02 2021 Ct. No.3 b.das Calcutta High Court In the Circuit Bench at Jalpaiguri Appellate Side W.P.A. 607 of 2019 Shib Sankar Das Vs.
State of W. B. & Ors.
Mr. Kumar Shantanu ...for the petitioner.
Mr. Bikramaditya Ghosh ...for SJDA.
Mr. Subir Kr. Saha, AGP.
Ms. Bedashruti Bose ...for the State.
Heard the learned advocates for the parties. The order impugned in this matter is the order passed by the appellate authority on 23rd July, 2018 passing the order imposing the penalty of Rs.30,000/- in the disciplinary proceeding on the charge of causing financial loss to the respondent employer.
Learned advocate appearing for the petitioner failed to point out violation of any statute or rule or regulation or the law point to establish that why the order of the appellate authority is bad or is not tenable in the eye of law.
Scope of interference of this writ petition in disciplinary proceeding is very limited, that is, it cannot re-appreciate the evidence or any question of facts unless it is perverse on the face of it.
I have considered the order of the appellate authority, I do not find any reason to interfere with the impugned order and, accordingly, this writ petition is dismissed. W.P.A. No.607 of 2019 is dismissed and there will be no order as to costs.
Urgent certified photostate copies of this order, if applied for, be given to the parties upon compliance of all formalities.
