1. Report filed on behalf of the Kalimpong Municipality is taken on record.

2. The petitioner prays for releasing the pensionary dues.

3. From the report filed by the Kalimpong Municipality, it appears that, the dues of the petitioner are being released in installments. Payment till the month of May, 2024 has been released.

4. The municipality claims to be facing financial crisis for revising pension in terms of ROPA-19.

5. The municipality has averred before the Court that the dues of the petitioner from June, 2024 onwards will be paid as soon as funds are received.

6. The instant writ petition is disposed of by directing the municipality to take steps for disbursal of the legal dues of the petitioner without any further delay.

7. The municipality shall ensure that the dues are paid on regular basis to the petitioner and the petitioner is not required to approach the Court for further relief.

8. The writ petition stands disposed of.

9. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
