The writ petitioner was JFMC authorized to ply a new commercial Gupsy vehicle at Khawchand Para JPW range in Jaldapara National Park. He was appointed as such on 4th October, 2017. By an order dated 22nd October, 2019, issued by the wildlife warden Jaldapara National Park, Madarihat suspended the petitioner from daily roster with immediately effect pending of final enquiry.

The petitioner submits that the Superintendent of Police, DIB, Alipurduar on 5th March, 2020 certified that no adverse records are found against the petitioner and with good moral character. The Block Youth Officer has also found in favour of the petitioner. The Madarihat Police Station has also indicated that there are pending cases against the petitioner.

The petitioner has been representing to the Assistant Wildlife Warden, Jaldapara for revocation of his suspension from time to time but in vane. In that view of the matter, the respondent No. 5 the Assistant Wildlife Warden, Jaldapara National Park, Madarihat shall take a suitable decision on the petitioner's representations for revocation of the order of suspension within a period of 1 month from the date of communication of this order.

With the aforesaid observations, WPA 992 of 2021 is thus disposed of.

There will be no order as to costs.
