Records reveal that on 10th May, 2022 when the matter was taken up, Ms. Smita Sinha (Mitra) appeared on behalf of the petitioner. It was submitted on behalf of the petitioner that the senior counsel engaged by the petitioner namely, Mr. Sunil Kumar Sarkar was unwell and an adjournment was prayed for on his ground. The matter was adjourned and directed to appear in the next circuit. On 3rd August, 2022 when the matter next appeared, Ms. Sinha (Mitra) learned advocate for the petitioner submitted that her senior counsel Mr. Sarkar had expired some days back. Considering such submission, the matter was adjourned till the next Circuit. On 31st October, 2022 when the matter was taken up, the petitioner was directed to serve a copy of the writ petition again upon the respondent nos. 6 to 15 and file an affidavit of service to that effect. A copy of the writ petition was also directed to serve on Mr.

Deborshi Dhar, learned advocate representing the Mayor, Siliguri Municipal Corporation.

The matter has been listed in this Circuit Bench. Today, no one appears on behalf of the petitioner. No adjournment is sought for by the petitioner. No one has also applied for virtual link to represent the petitioner in this writ petition.

Since no one appears on behalf of the petitioner, the writ petition is, therefor, dismissed for default. Interim order, if any, stands vacated.
