Banerjee/BP) Ms. Suman Sehanabis ... for the petitioners Mr. Bikramaditya Ghosh Ms. Bedushruti Bose ..for the State The petitioners claim that a property know as „Dev Bakshi Bari‟ at Hitendra Narayan Road, Ward no. 18, Cooch Behar Town has been identified by the Cooch Behar Municipality as a heritage building under the West Bengal Heritage Commission Act, 2001 and the West Bengal Heritage Commission Regulations.

It is submitted that the enquiry by the Special Cell for Heritage of the Cooch Behar Municipality has opined that "so there is no reason to include Dev Bakshi Bari as a places of Heritage"(sic). In that view of the matter, the Board of Councillors of the Municipality shall consider a detailed representation that shall be made by the petitioners within a period of fifteen days from date.

The said representation shall be enquired into the concerned officials of the concerned Municipality afresh and the matter shall be placed before the Board of Concillors in the next three available meetings and the decision so taken may be communicated to the petitioners within fifteen days thereof.

With the above observation, this writ petition is disposed of.

The petitioners shall serve a copy of this order upon all the respondents along with a copy of the writ petition afresh.
