The petitioner is the defendant no.6 in the suit being Title Suit No.5 of 2026 which is now pending before the Court of the learned Civil Judge, Senior Division, Alipurduar. The petitioner had filed an application under the provisions of Order VII Rule 11 of the Code of Civil Procedure, 1908 (in short 'CPC') for rejection of the plaint.

After hearing the parties and by consent, I direct the petitioner's application under Order VII Rule 11 of CPC be disposed of as expeditiously as possible but not beyond three months from this date.

Let a copy of this order be filed by the parties before the Trial Court on the next date which I am told is 3rd June, 2026 so that unnecessary adjournments are not being sought for by the parties.

Nothing further remains to be adjudicated in this application.
