Mr. Hirak Barman Mr. Pretom Das ...For the State respondents The grievance of the petitioner pertains to purported non-payment of compensation in respect of acquisition proceedings pertaining to his premises.

It is submitted that the respondent authorities without any notice of opportunity of hearing have acquired the premises of the petitioner.

On behalf of the N.H.A.I. it is submitted that no portion of the land of the petitioner has been acquired. The State respondents also submit that the petitioner is not the owner of the subject premises and has produced no documents in this regard.

By a representation dated 6 March, 2023, the petitioner had prayed for consideration of his representation. It is submitted on behalf of the petitioner that full particulars of the purported land are fully spelt out in the writ petition. The State respondents submit that the representation of the petitioner may be considered in accordance with law.

In such circumstances, the respondent no.6 is directed to consider and dispose of the representation of the petitioner in accordance with law, preferably within a period of eight weeks from the date of communication of this order.

It is made clear that there has been no adjudication on the merits of the representation of the petitioner and the same shall be disposed of in accordance with law without being influenced by any observation made on the merits of the case. WPA/940/2023 stands disposed of.
