Mr. Hirak Barman Mr. Momenur Rahman, ......for the State The grievance of the petitioner is directed against the wrongful and illegal interception of trucks carrying areca nuts belonging to the petitioner by the concerned police authorities. It is submitted on behalf of the petitioner that in view of the illegalities and excesses by the police authorities, the petitioner has been unnecessarily harassed.
It is also contended on behalf of the petitioner that with the advent of the GST regime, any truck transporting goods and having an e-way bill is not liable to be plagued.
Moreover, the factum of e-way bill can always be verified by the State Authorities in the GST portal and does not require unnecessary harassment of the petitioner.
The State is represented and submits that there is no question of causing any inconvenience to any driver of a vehicle which is carrying a valid e-way bill.
In view of the facts which have transpired culminating in the filing of this writ petition, MAT/40/2024 stands disposed of by directing that in the event of any vehicle carrying the goods of the petitioner having a valid and lawful e-way bill (which fact can also be verified on the GST portal by the concerned police Authorities), the concerned police authorities shall not cause any harassment or inconvenience to such vehicle. The above direction is passed on the assumption that the trucks carrying the goods of the petitioner have otherwise complied with all formalities and statutory compliances.
Liberty is granted to the petitioner to file a fresh writ petition in accordance with law if the changed circumstances so warrant.
With the above directions, CAN/2/2024 also stands disposed of as infructuous.
