The petitioner has filed the instant application for bail under Section 439 of the Code of Criminal Procedure after being arrested in connection with Kurseong Police Station Case No. 135 of 2020 under Sections 326/307/34 of the Indian Penal Code. The learned Counsel for the petitioner submits, on instruction, that his client does not want to move the instant application for bail. Hence the application for bail being CRM 555 of 2021 is dismissed for non-prosecution.
