Mr. Suddhasatva Banerjee, learned counsel appearing for the petitioner submits that, the petitioner is engaged with a development work at a particular piece of land where the petitioner is being faced with various obstructions by the local miscreants including extortion of money.
Drawing attention of this Court to Annexure P-2 at page 75 to the writ petition learned counsel submits that, on February 26, 2024 they have submitted a complaint before the Kotwali Police Station. The left hand side bottom of the said document shows the receit endorsement by the Police Station. Still no F.I.R. has been registered.
Ms. Bedashruti Bose, learned State counsel appearing for respondent Nos. 1 to 4, on instruction submits that, F.I.R. has already been registered. In view of the above, this Court directs the appropriate authority of the Kotwali Police Station to take further steps on the basis of the said complaint dated February 26, 2024 strictly in accordance with law and proceed accordingly expeditiously.
In the event, the F.I.R. has already been registered, then the police authority shall take all further steps there under as expeditiously as possible in accordance with law.
Since affidavits are not called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents.
It is made clear that, this Court has not gone into the merits of the allegations of the petitioner in any manner and the petitioner shall be free to avail all the other legal remedies strictly in accordance with law, if available to it.
On the above terms, this writ petition, WPA 811 of 2024 stands disposed of, without any order as to costs.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties expeditiously, on compliance of usual legal formalities.
