APP Mr. Ujjwal Luksom ...for the State Mr. Sah, learned counsel for the petitioners submits that the present application has been preferred for quashing the first information report in connection with Matigara Police Station case no. 110 of 2024 dated 17th February, 2024 which is presently pending before the learned Chief Judicial Magistrate, Siliguri being G.R. case no. 563 of 2024.
He further submits that in the meantime, the police has submitted charge-sheet after completion of investigation. In such view of the matter, he wants to withdraw the present application with a liberty to file afresh challenging the chargesheet submitted after completion of investigation along with the first information report.
Learned counsel for the opposite party did not raise any objection.
In such view of the matter, CRR 122 of 2024 is hereby withdrawn with liberty to file afresh.
The certified copy of documents may be returned to the learned counsel for the petitioners on condition of placing authenticated copy of the same in the record. Learned counsel for the State is present with case diary. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
