None appears for the State respondents despite service.
Mr. Pritom Das, who usually appears for the State and is present in Court today, is requested to represent the State in this matter. His appointment be regularized by the office of the learned Legal Remembrancer. The petitioner should serve copy of the writ petition along with annexure thereto to Mr. Das in course of this day. The innocuous prayer of the petitioner is for consideration of the RTI application filed by him before the concerned Authority being the Chairman, Cooch
Behar District Primary School, Cooch Behar, the 7th respondent herein.
Learned counsel for the petitioner has taken this Court to Annexure P/4 of the writ petition which demonstrates that the 7th respondent was directed by the Law Officer and Joint Registrar, West Bengal Information Commission vide letter dated 11th June, 2015 to dispose of the RTI application filed by the father of the petitioner within 30 days and furnish a report to the Commission. The petitioner complains that the said instruction has not yet been complied with.
In view of the above, this Court is inclined to hold that keeping the writ petition pending shall not serve any useful purpose and the 7th respondent may be directed to dispose of the RTI application filed by the petitioner/his father within a stipulated time frame. Accordingly, the writ petition is disposed of directing the 7th respondent to act in terms of the letter dated 11th June, 2015 issued by the Law Officer and Joint Registrar, West Bengal Information Commission and dispose of the RTI application in accordance with the provisions of the Act within two months from the date of communication of this order.
With the above observations and directions, W.P.A. 1030 of 2022 is disposed of.
There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
