This is an application under Article 227 of the Constitution of India.

From the endorsement of the Registry it appeared that no caveat was lodged.

The petitioner had instituted a claim case before the jurisdictional Motor Accident Claim Tribunal, Jalpaiguri, annexure P-3 at page 31 to this revisional application.

The proceeding was subsequently transferred before the Motor Accident Claim Tribunal Jalpaiguri presided over by the Additional District Judge, 4th Court, Jalpaiguri.

Drawing attention of this Court to the order sheet, annexure P-5 at page 42 onwards, Ms.

Suman Sehanabis (Mandal), learned counsel for the petitioner submitted that, no effective step was been taken and effective progress had taken place for hearing the proceeding being MAC case No.106 of 2021 instituted by the petitioner.

On a scrutiny of the order sheet this Court is also of the same view that no progress had taken place in the claim case.

In view of the above, in exercise of the superintending power under Article 227 of the Constitution of India, to sub-serve justice, the jurisdictional Tribunal, where the said MAC Case No.106 of 2022 is pending, is directed to deal with and dispose it of as expeditiously as possible following the procedure of law preferably within a period of one year from the date of communication of this order. With above observation, only, the revisional application, C.O.32 of 2023 stands allowed without any order as to costs.
