1. The petitioners herein pray for anticipatory bail apprehending arrest in connection with Tufanganj Police Station Case No190 of dated 02.05.2019 under Sections 186/188/332/333/307/353/34 of the IPC read with Sections 25/27 of the Arms Act, corresponding to G.R. Case No. 275 of 2019.

2. The complaint in the present case has been registered by the officiating/Copy Commander "A", Coy, Chengmari.

3. It appears from the written complaint that the incident in the present case has occurred when the BSF was trying to stop smuggling of cattles being done/transported to and from Bangladesh.

4. The incident occurred in the border area and from the case diary placed by the learned counsel for the State, it appears from the injury report at page 28, that one BSF personnel sustained gun short injury in the left lower abdomen with entry and exit wound.

5. Considering the nature of injury and the offence alleged, the materials in the case diary, this is not a fit case to grant anticipatory bail

6. The prayer for anticipatory bail of the petitioners is thus rejected.

7. CRM (A) 291 of 2026 is, thus, disposed of.

8. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
