Report dated 08.09.2022 submitted by the Inspectorin-Charge, Siliguri Police Station be kept on record. The said report reflects that the de facto complainant/opposite party no.2 has made a statement wherein he has categorically stated that he do not intend to pursue with the litigation. I find that the subject-matter of this revisional application relates to Siliguri Police Station Case No. 522 of 2019 dated 01.08.2019 under Sections 403/406/420 of the Indian Penal Code. The nature of the dispute complained of is private and personal in nature and no public policy is involved.
Having regard to the subject-matter of the case and the dispute, I am of the opinion that as the parties have entered into an amicable settlement and the de facto
complainant/opposite party no.2 is not interested in pursuing the criminal case, no useful purpose would be served by continuing with the investigation of Siliguri Police Station Case No. 522 of 2019 dated 01.08.2019. Thus, all further proceedings of Siliguri Police Station Case No. 522 of 2019 dated 01.08.2019 under Sections 403/406/420 of the Indian Penal Code corresponding to G.R. Case No. 2368 of 2019 are hereby quashed.
Accordingly, the revisional application being CRR 100 of 2019 along with CRAN 2 of 2021 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
