Ms. Adhikary, learned advocate appears on behalf of appellant and submits, this appeal has been filed by mistake since, against impugned order no appeal lies. She prays for liberty to withdraw the appeal and apply for revision of impugned order. She also seeks return of certified copy of order no.6 dated 24th September, 2019 passed by learned District Judge, Darjeeling in Misc. Case no.4 of 2019.

The appeal is dismissed. Appellant has liberty to apply in revision. Certified copy of said order be returned to learned advocate for appellant on said learned advocate furnishing a self certified true copy. (Arindam Sinha, J.) (Biswajit Basu, J.)
