Learned counsel representing the petitioner submits that nothing has been seized from this accused petitioner. On the basis of the submission of the co-accused, from whom the substance was seized, this petitioner has been arrested. He further submits that the ground of arrest was not communicated to the petitioner. Relying upon the aforementioned facts, learned counsel has prayed for bail.

Learned Additional Public Prosecutor submits that from the memo of arrest, it transpires that the accused petitioner was intimated as regards to ground of his arrest. In addition, learned counsel also places before the Court about the antecedent of this accused petitioner being involved in another NDPS Case being Siliguri Court CR NDPS Case No.132 of 2022.

Considering the submission of learned counsels and the case diary, it transpires that the substance involved is of commercial quantity and on the basis of the statement of co-accused, this petitioner has been arrested. As regards to antecedent, this petitioner is also an accused in another NDPS case which is pending before the Siliguri Court being CR NDPS Case No.132 of 2022.

Considering the quantity of the substance, gravity of the offence and specifically the antecedent of the present accused, this Court is not inclined to grant bail to the petitioner. 5.

The application for bail is thus rejected.

The case diary is returned to the learned Additional Public Prosecutor in Court today.
