Being the highest bidder in a tender for plantation of vetivar plant in the land of embankment of the riverside, the petitioner was granted tender and issued supply order with regard to the said tender scheme and completed the work within scheduled time. The grievance of the petitioner is that despite completion of the said work no payment has been made to the petitioner by the authority till date. Several representations submitted by the petitioner in this regard went unheeded.
The representation submitted by the petitioner on 6th November, 2019 was forwarded to the Block Development Officer, Dinhata-I Block by the District Nodal Officer for taking necessary action.
subsequent representation was also submitted by the petitioner consideration of his claim on 13th May, 2020. The petitioner prays for a direction upon the authority to consider the representation and take necessary steps for payment due.
It is submitted on behalf of the State respondents that the 2nd and 4th respondents be directed to consider the representations within a stipulated time frame.
Upon consideration of the submission made on behalf of the parties and material on record, the writ petition is disposed of directing the 2nd and 4th respondents to consider and dispose of the representations submitted by the petitioner dated 6th November, 2019 and 13th May, 2020 within one month from the date of communication of this order after giving reasonable opportunity of hearing to the petitioner, in accordance with law.
The decision taken by the authority shall be communicated to the petitioner within a week thereof. With the above directions, WPA 1050 of 2022 is disposed of. However, there shall be no order as to costs.
Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted.
