Affidavit of service filed on behalf of the petitioner is taken on record.

The husband of the petitioner who was the sole bread earner of the family, was employed as WaterCarrier (Causal) at Sitai Development Block, Cooch Behar, expired on 23rd August, 2020.

The petitioner applied before the concerned authority for a suitable job on compassionate ground since the deceased was the sole earning member of the family.

It is submitted on behalf of the petitioner that the application of the petitioner dated 3rd February, 2021 was forwarded to the District Panchayat and Rural Development Officer, Cooch Behar by the Block Development Officer, Sitai Development Block on 24th September, 2021 for necessary action. The petitioner

complains that the application has not been disposed of as yet.

It is submitted on behalf of the respondents that the Secretary, Panchayat and Rural Development Department, Government of West Bengal, being the 2nd respondent herein is the appropriate authority to consider the application submitted by the petitioner. In view of the above, the 2nd respondent is directed to consider and dispose of the application submitted by the petitioner dated 3rd February, 2021 within one month from the date of communication of this order after giving reasonable opportunity of hearing to all the interested parties including the petitioner, in accordance with law. The decision taken by the authority shall be communicated to the petitioner within a week thereof. With the above observations and directions this writ petition being WPA 1051 of 2022 is disposed of. However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
