10.06.2026 Court No.4 Item No.9 AP/BP HIGH COURT AT CALCUTTA CIRCUIT BENCH AT JALPAIGURI CRM (NDPS) 273 of 2026 In Re: - An application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Madarihat Police Station Case No.14 of 2026 dated 03.02.2026 under Sections 21(c)/29 of the NDPS Act.

And In the matter of: Chamina Khatun ....Petitioner.

Mr. Ujjwal Luksom Mr. Sandipan Das Mr. Rounak Ghosh ...For the Petitioner.

Mr. Avrojyoti Das, APP Mr. Gobinda Ghosh ...For the State.

1.

Learned counsel representing the petitioner submits that nothing has been recovered from this accused petitioner, namely, Chamina Khatun. He further submits that the house from which contraband substance has been alleged to be seized belongs to her father-in-law. Banking upon the aforesaid fact and circumstance, learned counsel seeks bail.

2.

Learned Additional Public Prosecutor representing the State relies upon the seizure list and vehemently opposes the prayer for bail.

3.

On going through the case diary including the FIR and the seizure list, it transpires that 508 grams of brown sugar has been seized.

4.

Considering the huge quantity of the contraband substance seized and specifically on going through the FIR wherefrom the possession of the accused is also ascertained, this Court is not inclined to enlarge the petitioner on bail.

5.

The application for bail is thus rejected.

6.

The case diary is returned to the learned Additional Public Prosecutor in Court today.
