THE HIGH COURT AT CALCUTTA CIRCUIT BENCH AT JALPAIGURI 13.05.2024. C.R.M. (NDPS) 206 of 2024 28/tkm In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Kalimpong PS case no.221 of 2022 dated 12.8.2022 under sections 22(c) of the NDPS Act.

1. Heard learned lawyers for the parties.

2. We have considered the materials on record. Bail prayer of the petitioner was rejected by a co-ordinate Bench in January 2024. Amount of narcotics recovered is above commercial quantity. Trial is in progress. Prosecution assures this court that trial shall be completed within one year from the next date fixed for recording evidence subject to co-operation by the defence and systemic delays.

3. In view of the aforesaid assurance and as bail prayer of the petitioner was rejected in January 2024 we are not inclined to grant bail to the petitioner at present.

4. Accordingly, prayer for bail is rejected.

5. We request the trial court to conduct the trial with due expedition in light of the assurance given by prosecution.

6. Parties shall cooperate with the trial court and communicate this order for due compliance.
